New law smothers paper leak

The Public Examinations (Prevention of Unfair Means) Act, 2024, which came into effect on June 21, establishes stiff penalties for those involved in exam irregularities and cheating in examinations.
The Act aims to prevent unfair means in public examinations conducted by major bodies such as the Union Public Service Commission (UPSC), Staff Selection Commission (SSC), railways, banking recruitment examinations, and the National Testing Agency (NTA), among others.
The Act prescribes a minimum three-year jail term, extendable to five years, or fine upto Rs 10 lakh for individuals caught leaking exam papers or tampering with answer sheets.
Authorities can arrest individuals without a warrant and they cannot seek bail as a right hence all offences under this Act are non-bailable and cognisable.
Examination service providers who possess knowledge of a potential offence but fail to report it can be fined a hefty Rs 1 crore.
The law takes a harsher stance on organised cheating. Senior officials within service providers who knowingly participate in or facilitate such activities face a minimum three-year sentence, potentially extending to 10 years, along with a Rs 1 crore fine. Examination authorities or service providers involved in organised exam malpractice can be imprisoned for a minimum of five years and a maximum of 10, with the same Rs 1 crore fine.

Government acted with speed

The Bill proposing this law was introduced in Lok Sabha on 5th February before being passed the next day Rajya Sabha passed the bill on 9th February.
It received Presidential assent on 12th February and was notified on 21st June by the Central government in the Official Gazette.
The notification of the law comes amid nationwide controversy over malpractices alleged in the conduct of the National Eligibility cum Entrance Test (NEET) for undergraduate medical college admissions.

Need of the Act

National Eligibility Test (UGC-NET) and the National Eligibility cum Entrance Test (NEET) are significant exams for aspiring academics and medical professionals, respectively.
About 24 lakh candidates appeared for NEET on 5th May, 2024 facing accusations of paper leaks particularly in Bihar. Additionally, the UGC-NET was cancelled entirely due to suspicions that the integrity of the exam was compromised.
Against this backdrop, the NTA announced the postponement of the June edition of the Joint CSIR-UGC-NET, citing unavoidable circumstances and logistic issues.

Editor’s Note

The Bharatiya Janata Party (BJP)-led government has said the act will bring greater transparency fairness and credibility as it is the first federal legislation to prevent malpractices in examinations. Though few experts are apprehensive that coaching centres collude with students to make them pass the examinations.
